Jankee and 32 Others Respondents FROM THE COURT OF APPEAL OF MAURITIUS ————— JUDGMENT OF THE LORDS OF THE JUDICIAL COMMITTEE OF THE PRIVY COUNCIL, Delivered the 5th July 2000 —————— Present at the hearing:- Lord Browne-Wilkinson Lord Hope of Craighead Lord Clyde Lord Hobhouse of Woodborough Lord Millett [Delivered by Lord Millett] —————— This is an appeal from a judgment of the Supreme Court of Mauritius given on 5th July 1994 affirming a judgment of the Industrial Court which awarded the respondents a total of Rs748,888.50 as wages in lieu of notice and severance allowance for unjustified dismissal at the punitive rate with interest and costs. The appellant claimed that he had orally dismissed the first group on the 5th January 1981 and he had merely confirmed their dismissal by the letter of the 13th January 1981, but the Magistrate rejected his evidence. (2)(a) No employer shall dismiss a worker unless he has afforded a worker an opportunity to answer any charges made against him and any dismissal made in contravention of this paragraph shall be deemed to be an unjustified dismissal …” Section 36(9) authorises the Court to order the employer to pay interest at a rate not exceeding 12% from the date of the termination of the agreement to the date of payment. Section 16 provides that the authority is to deduct from the amount of the grant payable to the school the amount of the emoluments payable by the school to its staff and pay such emoluments directly to the staff concerned. Section 16(4) provides that:- “Notwithstanding any other enactment, where the emoluments of a member of the staff are paid directly to him by the Authority:- (a) the Authority shall not be regarded as the employer of that person by reason of the payment of the emoluments to him; In relation to the first group, he found that they were dismissed on the 13th January 1981, that is to say more than 7 days after the appellant became aware of the misconduct on which he relied, in breach of section 32(1)(b)(ii) of the Labour Act. He found that none of the respondents had been afforded an opportunity to answer the charges made against them, in breach of section 32(2)(a) of the Act, and that their dismissals were accordingly all deemed to be unjustified. He found that the teachers who had been dismissed joined the staff of another College and were paid their salaries by the Authority out of the grant payable to that other College. Severance pay is clearly payable whether or not the employee’s dismissal is contrary to the provisions of the Labour Act. The Board has exclusive jurisdiction to adjudicate on disputes concerning discipline and dismissal, and to decide for example whether summary dismissal is justified. If the employer dismisses the employee in the teeth of a decision of the Board that dismissal is unjustified, the dismissal, even if unlawful, is effective. The employee is entitled to treat the dismissal as unjustified and claim severance pay at the penal rate. The allowance is payable at the penal rate under section 36(7) whenever the Court finds that the employee’s dismissal was unjustified. The Magistrate found that the dismissal of the first group of teachers for misconduct was contrary to section 32(1)(b)(ii) because it was not effected within 7 days of the appellant’s becoming aware of the misconduct relied upon. The appellant pointed out that there was nothing in section 32(1)(b) which deemed such dismissal to be unjustified, and that this was in stark contrast to section 32(2)(a). An employer’s failure to comply with section 32(2)(a) deprives the employee of an opportunity to obtain a ruling that his dismissal was unjustified, and it is this fact which explains the inclusion of a deeming provision in section 32(2)(a).

Log 62Troy NY to Amsterdam NY5:10 AMWednesday, July 05, 2000Tied to lock #11 wallAmsterdam NY.DayThe guidebook says to leave Troy docks at 7 AM to get the best jump on the Eire Canal, and that is exactly what we did. By the time 6:30 came around we were both antsy to get started, and by 6:45 we were rolling.The first lock was Troy Lock, and it was only about ½ The first lock we came to was Lock #2. (No fancy names for these New Yorkers….and where did lock #1 go to?) It was an old lock and when you got to the top of the 45-foot lift you could look over at the original lock that was dug by hand back over 170 years ago. We no more than got out of that lock and we were back in another one (Lock #3). Once we got out of lock # 6 things started to spread out a little, and the locks were about 30 minutes to an hour apart. (I have read that book a few times now, but I’m still not sure where we will end up, because it’s hard to plan with all of the locks) We did end up eating on the boat (great chicken on the grill with some of Debs great pan fried potatoes) and just sitting around watching the boats go by.

Yesterday we went through a lock that lifted us up over 40 feet, in about 11 minutes.We untied at about 6:30 yesterday, and made it to our first lock at exactly 7AM. (To long a story, let’s just say they were not your normal kind of boaters) Anyway….as I have said there is a speed limit of 10 MPH on the waterway, and we wanted to get ahead of these guys, so we wouldn’t have to lock through with them all of the way. When we left the lock wall in Amsterdam there was no sign on life on their boats so we knew we would make it to the first lock before them, and stay ahead of them all day. Well, by the second lock (where we had a slight delay getting in the lock) they were right behind us, and we knew they would probably catch us at the next lock. So we took advantage of it, and made it a relaxing afternoon of cleaning up the boat, and telling stories.At the marina (they call it a marina, but actually it’s not a marina, it’s just a long wall where about 8 to 10 boats can tie up) they said you could you could call two different local restaurants, and they would come and get you for dinner.

Array They also serve chops, fish, and shelfish, but I don’t know anyone who has ordered anything but steak at this place. They offer a number of different cuts of beef, and one can get a steak as small as a 12 ounce filet mignon, or as big as a 48 ounce porterhouse. As usual, I ordered the steak medium rare, and I also got a caesar salad and a number of sides which included, asparagus, a baked potato, hashbrowns, and creamed spinach. This restaurant takes a back seat to most steak places I’ve been to including Luger’s, Sparks, and the Capriccio Grill.

The conference is always about equal parts inspiration and feelings of unworthiness, but I think this time around the inspiration outweighed the guilt.This marked the tenth anniversary of DGH, so the meeting opened with a retrospective of how it all began - with Lannie Smith helping to build the Jaime Solorzano Bridge in Morazan, El Salvador, so that people would not have to swim across a river to go to school or the local clinic or simply cross to the other side of town (the bridge is named afte a medical student who drowned crossing the river).There was recognition of the 60th anniversary of the US dropping the bomb on Hiroshima and Nagasaki (140,000 individuals died within the first 6 months, 160,000 additional deaths over time as a result of fallout; You are not obligated to complete the work, but neither are you free to abandon it.He talked of his work in El Salvador, of how people would simply disappear off the streets after attending union meetings or discussions about social justice.He was a member of the air force and flew combat missions during the Vietnam war, but when he refused to participate in the invasion of Cambodia he was declared 10% mentally disabled, which he says used to bother him until he realized that also meant he was 90% intact!One of the conference attendees from Uganda offered this sobering statistic - in Uganda there are approximately 25,000 individuals for every one doctor.Our second keynote speaker was Kathy Kelly, an old school hippie/activist.

Wheat gluten is a source of protein.The recall covers the company’s cuts and gravy style food, which consists of chunks of meat in gravy, sold in cans and small foil pouches between Dec. 3 and March 6 throughout the U.S., Canada and Mexico.The pet food was sold by stores operated by the Kroger Company, Safeway Inc., Wal-Mart Stores Inc.

Its a good system.After telling people in the hostel about last sunday night at the Baile Funk in the favela, everybody was keen on going, thus roughly 12 of us gringos went back to the gun slinging, drug snorting party that you have to see to believe. This time it was a bit different, not the drugs and the guns, but the fact that people were actually firing their guns into the air throughout the night. All in all it was a good night, but around 5am or so, the shooting into the air was extremely frequent, and we decided it was probably best to take leave of the party then. We ran into some transient guy who wanted to come with us, and we decided he would be an interesting addition to our late night activities. The transient friend, Alesandro I believe, engaged in a conversation with a rather large woman for quite some time, but it began to get heated, and there was some yelling and screaming. As things between Alesandro and the transvestite turned quite bitter, our friend Diego politely advised us that this was our time to leave as all the patrons in the bar were quite angry, and there was a chance that this giant transvestite could kill us.

Seeing that I have already accomplished my goal for ‘05 get a job, keep it longer than three months, buy a new car, ( 99 dodge avenger) and losse 20 lbs. Because, I am still considered a freshman until winter semster I think I am going to take 20 credits that semister then that will be about 47 credits then take about 13 credits in the spring so that way I can transfer to SVSU.

Not that it’s a bad room or anything, and it’s got a balcony overlooking the little town square on base. Unfortunately, said town square becomes the hangout for all the kids on base between the hours of 6pm-9pm or so, and really, I just want some peace and quiet then.

The Phillies are in last place having lost 10 of their last 15 and the Mets were only one game ahead of them going in to last night’s game with the unpredictable Jae Seo taking the mound for the Mets.But Seo pitched a bit like Cy against the Phillies last night, holding Philadelphia hitless until David Bell’s single to left with two outs in the fifth. The Seo move makes sense only in that he won’t be able to start for another 4 games or so anyway and may as well open up the rotation for someone else but geez, neither Zambrano nor Glavine have proven themselves to be anything more than fatalistic liabilities on the mound this season and even against the (13-13) Brewers, do you really want either of them pitching for you?*****Nevertheless, this afternoon’s game against the Phillies will see our latest and perhaps only remaining pitching saviour in Kris Benson take the mound for the first time this season even though if he’s doubtful to pitch past the fifth inning.

It incorporates a bridge which turns the track into a circuit approximately 7km long, and is known as The Bay.For the last few months Milord and I have been having a race around it almost every Sunday - he does three circuits on his bike, and I jog it. I’m not much of a jogger, so it’s jolly hard work, and although Milord enjoys cycling 21km is a long way!The first time we did it I mostly walked, and finished in 61 minutes, and Milord managed 58 minutes.
